Drma Terms of Use

These Terms of Use are a legally binding agreement between you and Super Interactica株式会社 ("Company", "we", "us", or "our") concerning your access to and use of the Drma mobile application and related products and services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Services.

The Services are intended for users who are at least 13 years old. If you are a minor in your jurisdiction, you must have permission from a parent or legal guardian and must use the Services only as permitted by applicable law and platform rules.

1. The Services

Drma is an AI-assisted creative studio for making short dramas and other audiovisual content. Depending on the feature, the Services may let you submit a story idea, character references, prompts, images, audio, video, duration, aspect ratio, or other instructions and generate story plans, scripts, storyboards, images, shot videos, edited media, and complete drama videos.

The Services may also include separate image generation, video generation, and video-effects tools. Features, models, supported formats, output quality, and availability may change over time.

The Services are not designed for regulated uses such as medical diagnosis, emergency response, legal advice, financial advice, or handling regulated health, financial, government-identification, or confidential business data.

2. Accounts and Eligibility

You must provide accurate information and keep your account secure. You are responsible for activity performed through your account and must notify us promptly if you believe your account has been accessed without authorization.

You may not create an account for a person who is under the applicable minimum age, evade an account restriction, or use another person's account without authorization.

3. Intellectual Property in the Services

We or our licensors own all rights in the Services, including the software, user interface, design, trademarks, logos, workflows, databases, and service content. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose.

You may not copy, resell, sublicense, reverse engineer, scrape, interfere with, or create a competing service from the Services, except where applicable law expressly permits it.

4. User Content and AI-Generated Content

"User Content" means prompts, story descriptions, character names, images, video, audio, text, feedback, and other materials that you submit. "AI-Generated Content" means content generated, edited, transformed, or assembled by the Services from User Content or other instructions.

You retain your rights in User Content. You grant us a limited, non-exclusive license to host, store, reproduce, transmit, process, analyze for safety, and otherwise use User Content and resulting project data only as reasonably necessary to provide, maintain, secure, support, and enforce the Services, subject to our Privacy Policy.

Subject to these Terms, applicable law, and third-party rights, you may use AI-Generated Content for personal or commercial purposes. We do not claim ownership of your AI-Generated Content. However, AI output may not be unique, may resemble output generated for other users, and may not qualify for copyright or other legal protection.

You are responsible for reviewing every output before publishing, sharing, monetizing, or relying on it. We do not guarantee that output is accurate, lawful, safe, non-infringing, suitable for a particular purpose, or available for exclusive use.

5. Rights and Permissions for Uploaded Materials

Before you upload or submit any material, you must have all rights, licenses, permissions, releases, and lawful bases required for us and our service providers to process it and for you to use the resulting output.

This includes permission to use a person's name, image, likeness, voice, performance, or other personal data, as well as music, footage, artwork, trademarks, scripts, and other third-party materials. Do not upload confidential information, passwords, government identifiers, financial information, health information, or other sensitive data unless the Services expressly support that use and you have a lawful basis to provide it.

6. Purchases, Subscriptions, and Points

Some features require a paid subscription or points. Prices, taxes, included benefits, and point amounts are shown in the applicable app store or purchase screen before you complete a transaction.

6.1 Subscriptions

Subscriptions are recurring purchases. Unless canceled through the applicable app store before the renewal date, a subscription automatically renews for the same period and the payment method is charged according to the store's rules. Canceling stops future renewal but normally does not end the already-paid period.

6.2 Point Packs

Point packs are one-time purchases and do not automatically renew. Points are virtual service credits, have no cash value, cannot be withdrawn, exchanged, transferred, or resold, and do not expire while the account remains available. Points may only be used through the account that purchased or received them.

6.3 Generation Charges and Failed Requests

Generation and editing features may deduct points according to the price shown in the app. If a generation or editing request fails because of a technical, service, or model failure, the points charged for that failed request will be returned automatically or through a reasonable account adjustment. A request blocked for policy violations, or canceled after processing has begun, may be handled according to the applicable in-app rules.

6.4 Refunds

Purchases are handled by the applicable app store or payment platform. Refunds are subject to applicable law and the relevant store's refund rules. Nothing in these Terms limits non-waivable consumer rights.

7. AI Safety and Prohibited Uses

You must not use the Services to create, request, upload, distribute, or share content that is illegal, harmful, abusive, deceptive, or contrary to these Terms or applicable platform rules. In particular, you must not use the Services for:

We may block a prompt, upload, generation request, or output before it is processed, displayed, stored, shared, or exported.

8. Moderation and Graduated Enforcement

We may use automated classifiers, keyword and image checks, provider safety systems, user reports, and authorized human review to detect policy-sensitive activity. A safety check may prevent a request from running even if the request was submitted successfully.

We use a graduated enforcement approach when appropriate:

  1. Warning, explanation, or blocking of a specific request.
  2. Stricter review, temporary feature limits, cooldowns, or restrictions on particular generation tools.
  3. Temporary suspension of generation features or the account.
  4. Permanent account termination for severe, repeated, fraudulent, or deliberately evasive violations.

Severe violations, especially child-safety risks, non-consensual sexual content, serious threats, or repeated attempts to evade safeguards, may result in immediate suspension or termination without a prior warning. We may retain records of safety events and enforcement decisions to protect users, enforce these Terms, and prevent repeat abuse.

If an account is suspended or terminated, access to the Services, projects, generated content, subscriptions, and points may be restricted to the extent permitted by law and applicable platform rules.

9. Third-Party Services and AI Providers

The Services may rely on third-party AI models, storage, analytics, advertising, payment, authentication, and infrastructure providers. Your content may be processed by those providers as described in our Privacy Policy and their applicable terms.

Third-party services may have separate availability, retention, safety, and acceptable-use rules. We are not responsible for a third party's independent services, policies, or failures.

10. Privacy

Our Drma Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and AI-related inputs.

11. Availability, Changes, and Termination

We may update, suspend, limit, or discontinue features, models, output formats, or parts of the Services. We may suspend or terminate access if you breach these Terms, create safety or legal risk, abuse the Services, or if suspension is required to protect users or comply with law.

You may stop using the Services at any time. Sections concerning content rights, payments, disclaimers, liability, indemnification, dispute resolution, and any provisions that by their nature should survive will survive termination.

12. Disclaimer

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and security.

We do not guarantee uninterrupted operation, successful generation, preservation of content, or that AI-Generated Content will be accurate, lawful, safe, non-infringing, or suitable for your intended use.

13. Limitation of Liability

To the fullest extent permitted by law, we and our directors, employees, agents, affiliates, partners, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities.

Our total liability for claims arising from the Services will be limited to the amount you paid to us for the Services during the twelve months before the event giving rise to the claim, unless applicable law requires a higher amount.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, directors, employees, agents, partners, licensors, and service providers from claims, losses, liabilities, costs, and expenses arising from your User Content, your use of AI-Generated Content, your breach of these Terms, your violation of law or third-party rights, or your misuse of the Services.

15. Governing Law and Disputes

These Terms and your use of the Services are governed by the laws of Japan, without regard to conflict-of-law principles, unless otherwise required by applicable law.

Before filing a formal claim, you agree to contact us and allow a reasonable opportunity to resolve the issue in good faith. Nothing in this section limits rights or remedies that cannot lawfully be waived.

16. Changes to These Terms

We may update these Terms by posting a revised version and updating the date above. Where required, we will provide additional notice. Your continued use after the effective date means you accept the updated Terms.
