This End User License Agreement ("EULA") is between you ("End User" or "you") and Super Interactica株式会社 ("Licensor", "we", "us", or "our") for the Drma mobile application and any updates supplied by us (the "Licensed Application").
This EULA is concluded between you and Licensor only, not with Apple, Google, or any app store operator. Your use of AI generation, subscriptions, points, content, and related services is also governed by the Drma Terms of Use and Drma Privacy Policy.
The Licensed Application is intended for users who are at least 13 years old. Minors must have permission from a parent or legal guardian where required by applicable law or platform rules. Certain third-party AI services may impose additional age restrictions.
Drma is a mobile creative application that helps users create AI-assisted short dramas and other digital content. It may provide story planning, script generation, storyboard images, character references, shot videos, editing, video effects, and final video composition.
Subject to your compliance with this EULA and the Terms of Use, Licensor grants you a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to install and use the Licensed Application on compatible devices that you own or control. If you obtained the Licensed Application through Apple's App Store, this license is limited to Apple-branded products that you own or control and is subject to Apple's applicable Usage Rules.
This license does not transfer ownership of the Licensed Application, its source code, trademarks, interfaces, models, or service technology to you. All rights not expressly granted are reserved by Licensor and its licensors.
You may not, except where applicable law expressly permits it:
The Licensed Application may allow you to submit prompts, story descriptions, images, names, video, audio, and other content. You retain your rights in User Content, and you are responsible for obtaining all permissions needed to process it and use the result, including permissions for a person's likeness, voice, performance, or other personal data.
Subject to the Terms of Use, you may use AI-Generated Content for personal or commercial purposes. AI output may be inaccurate, non-unique, similar to content generated for another user, or not eligible for copyright or other legal protection. You are responsible for reviewing output and complying with applicable law before publishing, sharing, or monetizing it.
You must not use the Licensed Application to create or request illegal, abusive, deceptive, infringing, sexual-exploitation, non-consensual intimate, child-safety, severe-violence, hateful, fraudulent, or other prohibited content. You must not attempt to bypass safety filters, model restrictions, or moderation controls.
Drma may block requests and use a graduated enforcement process, including warnings, stricter review, temporary feature restrictions, temporary suspension, and permanent account termination for severe or repeated violations. Severe violations may result in immediate action without prior warning. Further details are in the Terms of Use.
The Licensed Application may require a compatible version of iOS, Android, or another supported mobile operating system. Current compatibility information is provided through the applicable app store listing. We may release updates, security fixes, feature changes, or model changes. Some updates may be required for continued use.
We do not guarantee that every feature will remain available on every device, operating system, region, or app-store version.
Licensor is responsible for providing maintenance and support for the Licensed Application to the extent required by applicable law or the applicable app store rules. For support, complaints, or claims, contact [email protected].
The applicable app store is not responsible for maintenance or support obligations for the Licensed Application.
Subscriptions, one-time point packs, generation charges, failed-generation point returns, refunds, and service features are governed by the Terms of Use and the applicable app store or payment platform rules. A point pack is a one-time purchase, does not automatically renew, and does not expire while the account remains available.
Licensor may process technical information, account information, User Content, project data, and AI request data as described in the Drma Privacy Policy. Drma may transmit prompts and media to third-party AI providers and may use automated or authorized human safety review where reasonably necessary to provide and protect the Services.
The Licensed Application may interoperate with third-party AI models, storage, analytics, advertising, payment, authentication, and platform services. Your use of those services may be subject to separate terms and privacy policies. Licensor is not responsible for independent third-party services, their availability, their policies, or their output.
If you obtained the Licensed Application through Apple's App Store, your use must comply with Apple's applicable Usage Rules and Apple Media Services Terms and Conditions. Apple is not a party to this EULA and is not responsible for the Licensed Application or its content.
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and may enforce it against you as permitted by applicable law. Licensor, not Apple, is responsible for addressing claims relating to the Licensed Application, including product liability, legal compliance, consumer protection, privacy, and intellectual-property claims.
If a third party claims that the Licensed Application, or your permitted possession or use of it, infringes that third party's intellectual property rights, Licensor, not Apple, is responsible for investigating, defending, settling, and resolving that claim.
If you obtained the Licensed Application through Google Play, your use is also subject to the Google Play Terms of Service and other applicable Google Play policies. Google is not responsible for the Licensed Application, its maintenance, support, content, or claims arising from your use of it, except as required by applicable law.
You may not use, export, or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction where you obtained it. You represent that you are not located in a country or region subject to a United States government embargo and are not listed on a United States government restricted-party list. You may not use the Licensed Application for purposes prohibited by United States export-control laws, including the development or production of nuclear, missile, chemical, or biological weapons.
To the fullest extent permitted by law, the Licensed Application and related Services are provided "as is" and "as available" without warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, or security.
We do not warrant that the Licensed Application will be uninterrupted, error-free, free from harmful components, compatible with every device, or capable of generating accurate, lawful, unique, or commercially usable AI output.
To the fullest extent permitted by law, Licensor and its directors, employees, agents, affiliates, partners, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Licensed Application or Services.
Licensor's total liability will be limited to the amount you paid for the Licensed Application or related Services during the twelve months before the event giving rise to the claim, unless applicable law requires otherwise. Nothing in this EULA limits liability that cannot lawfully be limited.
This EULA remains effective until terminated by you or Licensor. Your license ends automatically if you materially breach this EULA or the Terms of Use. Upon termination, you must stop using the Licensed Application and delete copies under your control, except where retention is required by law or the app store platform.
This EULA is governed by the laws of Japan, without regard to conflict-of-law principles, unless otherwise required by applicable law.
